1. General Informations

a. Talebook Sp. z.o.o. (limited liability company in Poland) is registered at Warsaw, Twarda 18, 00-105 Warsaw, National Court Register number 0000676714, Tax Identity Number 5272808138, share capital of 5.000 PLN, next as “we” or “Talebook”, is a provider of Talebook Service. Talebook provides costumes and businesses with service only to subscribers to the Service. The terms and conditions set the rules for users of this Service. By clicking the button “subscribe” subscribers accept these terms and agree to follow all of the conditions included. Please notice, that you are unable to use Service unless agreeing to all Terms and Conditions.
Moreover, Talebook reserves the right to reject your subscription by any reason permissible by law.

2. General Service terms

a. Talebook provides you with a Service which enables you to access our platform, which includes access to tools, Customer Service, and educational materials.
b. All features are enlisted under “Your Subscription” button.
c. We inform that occasionally we may make changes to Terms and Conditions. If so we will inform you with notice by sending an email. If you do not agree to any modifications you can terminate your Subscription by any time.

3. Enjoy Talebook account

a. All subscribers have to create an individual account in Talebook platform, secured by individual login and password. A user is the only responsible for keeping these credentials safe.
b. Talebook account works with the latest version of Safari, Mozilla Firefox, Chrome and Internet Explorer. Please make sure you have a device which has a connection to the Internet and installed browsers. These technical requirements enable you to use Talebook fully.
c. Customers are able to get a 30-day trial version for Talebool Service, which can be limited by Talebook in anyways. Please remember that you can only create one trial account, which can be transformed to a paid full version at any point. Talebook reserves the right to disabled a trial version for any reason as long as it is not an unlawful reason.
d. You can upgrade the Subscription at any time during your subscription. Please notice that when you upgrade your Subscription we will include it to your account, in proportion to a number of days to your Subscription, so that you can still make payments monthly.

4. Services provided by the third party

a. Talebook enables you to use third-party services, which may be limited by third party terms and conditions. Please notice that by using third-party services you agree to exchange your data by Talebook with a third party.

5. Use of Talebook

a. When you subscribe successfully to Talebook Service you agree to certain rules:
i. use Talebook accordingly to your purposes with tools provided by Service such as
ii. confirm your date and update them if necessary,
iii. keep your credentials (login and password) safe
iv. receive any information about the products and services of Talebook.

6. Payments and Cancellations

a. Paid subscription can be purchased by monthly and annual subscription. A user is obliged to pay in due time. You can check out Talebook pricing at http://talebook.io/pricing
b. Please notice that you get access to your account when we receive full fee due to your monthly or annual subscription (Pre- Paid).
c. We accept payments by credit cards and PayPal, if available in your country. Please notice that payment methods are different in countries, so be sure to choose one carefully.
d. Talebook subscription payment is automatically renewing the day after your monthly or annual subscription ends unless you cancel your paid subscription before the end of the current subscription.
e. If the payment is unsuccessful we try one again. Please inform us of any data changes according to your credit card information to avoid unnecessary problems. f. Talebook is not responsible for any fees charged by payment services.
g. When you need an invoice, we will provide you with one in 30 days of receiving a payment in an electronic way – by email.
h. Talebook may change the price of Subscription, only for periods not yet paid for. We assure that we will inform you in advance about it and you will have to accept the price change. Subscriber accepts price change by continuing using Talebook Service after the price change. If you don’t agree with a price change you can unsubscribe Talebook at any time.

7. What you can’t do

a. Talebook informs that any actions against a national/international law are not allowed. Violation of law or good industry practice is also not allowed.
b. Talebook does not monitor Subscriber’s activity but informed about any violation of national or international law, or violation of terms and conditions, it reserves a right to take actions such as suspending access to Service.
c. Talebook respects intellectual property right and we expect our subscribers to do the same. Users who take actions which are not permitted for example: coping, making any use of Talebook available for public, selling, renting or sublicensing Talebook Service, making Talebook Service available for other users by giving them login and password, or any activity which is not permitted by law or infringes intellectual property right may result in suspension or termination of Talebook account.
d. If you are a copyright holder, please inform Talebook of any content which infringes a copyright. You can do that:

8. Content generated by User

a. Subscribers are allowed to add any content available by Service for its intended purpose but we inform that you agree that any claims against Talebook related to Subscribers content that you post you will indemnify and hold Talebook harmless from and against all damages, expenses of any kind, and losses of any kind arising out of that claim.

9. Customers Service

a. Talebook provides Customers Service by mail. Please make sure to leave request with account name, because Talebook do not reply to anonymous requests. Talebook makes sure to respond within the reasonable time, mostly within 24 hours.

10. Termination and cancellation

a. Talebook reserves the right to terminate service when a user violates terms and conditions of Talebook or national/international law. We do not refund amount you paid in that cases.
b. You can cancel Talebook account at any time, by following instruction on website. We inform that it is the only way to cancel the account and we do not agree to cancelations made by email or mail. Subscription will be terminated with immediate effect, but Talebook allows users to restore their account within 60 days. Talebook reserves the right to refuse to restore account without reason.

11. Can you get a refund?

a. Subscribers who purchase paid Service or turn form trail version to a paid Service are allowed to cancel the subscription by any reason or time. However, Talebook do not refund any amounts that are charged to your credit card. Users of Talebook choose a pay as you go Service, so Talebook refuses to issue any refunds for a paid period- monthly or annual subscription. When you decide to pay for a month or year, you pay for certain period and no refunds will be issued even if you cancel immediately after you pay.

12. Warranty and disclaimers

a. Talebook makes sure to provide its Users with the best service. Please remember that Subscribers use Talebook Service at their own risk. Talebook Service is provided as is, without any warranty of any kind. Talebook Subscribers are the only one responsible for use of the service and for any content. Talebook is not liable for damage or loss of user’s data, so please make copies of them. To the fullest extent permitted by applicable law Talebook and or its representatives shall not be liable for any damage or loss. We inform that entire liability, in any event, is limited to the amount paid by the customer in one month. Customers agree that Talebook is not responsible or liable for any direct, indirect, damage or loss and any transactions between Users and third party.
b. To the maximum extent permitted by law in no event Talebook, its shareholders, employees, directors, successor be liable for direct and indirect, incidental, punitive, exemplary or consequential damages, any loss of use or data.
c. Talebook and Subscriber is not responsible for failure of service due to Force Majeure or other occurrences beyond reasonable control of the party.
d. To the maximum extent permitted by law user agrees to indemnify and hold Talebook harmless from and against all losses and damages and expenses of any kind.

13. Jurisdiction

a. This Agreement is governed by and shall be construed in accordance with the laws of Poland.
b. The parties submit all their disputes arising out of or in connection with this Agreement to the exclusive jurisdiction of Courts of law in Warsaw, Poland.

14. Final Provisions

a. Talebook reserves the right to change Terms and Conditions at any time by sending an email. Users accept these Terms and Conditions with the immediate effect, unless they terminate their subscription within 7 days.
